Dayton Docket

Jim Durham was named a National Fellow by the American College of Real Estate Lawyers for his outstanding legal ability, experience, and high standards of professional and ethical conduct in the field of real estate law. There are only 960 fellows nationwide and just 29 in Ohio.

Maureen Anderson is a contributing author for the book Privacy Rights in the Digital Age (ed. Christopher T. Anglim), which has just been released. You may find a copy in the Zimmerman Law Library at the School of Law.

Susan Brenner has a new publication, Cyberthreats and the Decline of the Nation-State, which explores the extraordinary difficulties a nation-state's law enforcement and military face in attempting to prevent cyber-attacks.

Jeanette Cox has new publications including, "Reasonable Accommodations and the ADA Amendments Act's Overlooked Potential," 24 George Mason Law Review __ (forthcoming November 2016); "Are Car Dealership Service Advisors Entitled to Overtime Pay?," 43 Preview of United States Supreme Court Cases (ABA) 7 (2016) (April 2016); and "May a Court Order the EEOC to Pay Attorney Fees for Failure to Fulfill its Pre-suit Obligations?," in Preview of United States Supreme Court Cases.

Susan Elliott's book for children about negotiation and peer mediation titled, Haki Finds Common Ground, was recently published. The book was funded by a grant from the Ohio State Bar Foundation for distribution in the Dayton public schools.

Denise Platfoot Lacey presented, "Externships: Digitally Enhanced for Your Learning Pleasure" at the Externships 8 national conference in Cleveland, Ohio. She also was appointed to several boards, including the Board of the Greater Dayton Volunteer Lawyers Project; the Best Practices Advisory Sub-Committee of the AALS Externship Committee; and the Supreme Court of Ohio Commission on Professionalism.

Tracy Reilly was interviewed and quoted in an article by the Dayton Business Journal regarding the supervised legal work being performed by the School of Law Intellectual Property Clinic students for the benefit of several Dayton community businesses.

Staci Rucker was selected to participate in the University of Dayton Creating Inclusive Communities project. The goal of the CIC Project is to establish sustainable infrastructure to foster on-going conversations on privilege in all its forms and to encourage and facilitate sustainable actions steps toward greater social justice on campus and beyond. The CIC project culminated with a cohort of about 20 faculty and students that attended the White Privilege Conference that was held in Philadelphia. Rucker was also elected Treasurer of the Association of American Law Schools (AALS) section on Academic Support. This is a three-year term where she will serve as chair of the section.

Lori Shaw and Victoria VanZandt conducted a workshop entitled, "The Language, Process, and Cycle of Assessment" for the faculty of Duquesne Law School.

Blake Watson's article, "Fracking and Cracking: Strict Liability for Earthquake Damage Due to Wastewater Injection and Hydraulic Fracturing" was published in the Texas Journal of Oil, Gas, and Energy LawSSRN.

Media Appearances

Susan Brenner spoke to the Wall Street Journal on the fight dating back to 1877 between communications companies and the federal government. She also was quoted on whether unlocking your phone is the same as testifying against yourself.

Professor Emeritus Tom Hagel spoke to the Dayton Daily News on the Barton murder case being considered by the SCOTUS (subscription required to read full article). WHIO-TV (Dayton) also presented the story.

Charles Hallinan spoke to the Dayton Daily News on Judge Merrick B. Garland's SCOTUS nomination and the Senate's reaction.

Thaddeus Hoffmeister was quoted in The Columbus Dispatch on Ohio Supreme Court ruling that lawsuits over police videos can proceed. He also spoke to the Dayton Daily News on whether the caller who reported a man with gun in the Beavercreek Walmart case can be charged, as well as, on the a local murder trial proceedings. Hoffmeister was also quoted in the Dayton Business Journal on the new J.D./M.P.A. joint degree offered by the University of Dayton. He also was quoted on RT.com for jurors facing fines for using social media in court.

Blake Watson was quoted in an article by InsideClimateNews, regarding lawsuits in Oklahoma concerning oil and gas wastewater injection and earthquakes. He also spoke to Inside Energy on who should pay. Watson was also quoted here on "Frackers Use EPA Draft Water Report To Raise Doubts On Science."
